Waiver and Release of Liability

I hereby acknowledge and agree to the following terms as a condition of participating in the dance classes, fitness classes, and all other uses of space and services provided by FlowMotion Dance Studio, located at 2335 Westwood Blvd, Los Angeles, CA 90064:

 

Risk Acknowledgment

I recognize that my participation may involve physical activity that may present a risk of injury, including certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I hereby acknowledge that I am voluntarily participating in these activities and assume all risk of injury that may result.

 

Waiver of Liability

I, for myself and my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge FlowMotion Dance Studio, its officers, agents, employees, instructors, and representatives from any and all responsibilities, claims, rights, causes of action, and liabilities arising out of or related to any injuries, accidents, illnesses (including death), theft, or damages of any kind that I may suffer, including those caused by the negligent act or omission of the above parties.

 

Indemnification

I agree to indemnify and hold harmless FlowMotion Dance Studio from any and all liabilities or claims made by other individuals or entities as a result of any of my actions.

 

Medical Acknowledgment

I affirm that I have disclosed any medical conditions that may affect my participation, and, to the best of my knowledge, I am physically fit to engage in such activities.

 

Medical Treatment

In the event of an injury, I consent to receive medical treatment deemed advisable.

 

Media Release

I grant FlowMotion Dance Studio permission to photograph or video my participation and to use these images for promotional purposes.

 

Acknowledgment of Policies and Procedures

I agree to abide by the rules and policies of FlowMotion Dance Studio as published and amended from time to time.

 

Acknowledgement of Privacy Policy Statement

I agree with the Privacy Policy Statement of FlowMotion Dance Studio as published and amended from time to time.

 

Acknowledgment of Understanding

I have read this waiver and release of liability form, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

Policies and Procedures

 

Registration and Billing

Unless otherwise stated, fees for class registration, packages, services, and merchandise are non-refundable. In case of class cancellation, a credit will be issued for future classes.

 

Waitlist

There is no charge to join a waitlist. Charges apply only when a spot becomes available and is confirmed by the client.

 

Late Arrivals

Participants arriving late may forfeit their spot in the class.

 

Substitutions

FlowMotion Dance Studio will make efforts to provide notice of instructor substitutions as soon as possible, however, certain circumstances, including but not limited to last minute changes or emergencies may occur unannounced.

 

User Conduct

Clients must respect studio property, staff, fellow participants, and neighboring businesses and residents, maintaining a positive and respectful environment.

 

Service Refusal

FlowMotion Dance Studio reserves the right to refuse service at its discretion.

 

Health and Safety

Participants must follow studio safety protocols, including proper attire and reporting injuries.

 

Intellectual Property

All materials and content provided by the studio are the studio's property and for personal use only.

• Authorized FlowMotion staff and instructors for operational purposes

• Service providers who help us operate the website or manage communications (e.g., Zoom Phone/SMS platform)

• Legal authorities, if required by law or in response to a valid legal process

Minor Participation, Filming & Transportation Consent & Liability Waiver

This form is required for all FlowMotion participants under the age of 18 who are involved in rehearsals, off-site filming, performances, or related activities.

On-Site Parent Presence & Temporary Supervision

FlowMotion strongly encourages a parent or legal guardian to be present on the day of filming or offsite activities whenever possible.

However, we understand that parents and guardians may have scheduling constraints. With this consent, I authorize FlowMotion instructors, staff, or designated adults to temporarily supervise my child during FlowMotion-related activities, including offsite rehearsals and filming sessions.

This supervision applies only for the duration of the activity and only with guardian consent, and does not replace parental responsibility outside of FlowMotion activities.

 

Rehearsals With Adults & Environment Acknowledgment

I understand that FlowMotion rehearsals, filming sessions, and related activities may include adult participants (age 18 and over).

While FlowMotion strives to maintain a respectful, professional, and safe environment, I acknowledge that FlowMotion cannot control or monitor every individual interaction, behavior, conversation, or influence of other participants at all times.

By signing this agreement, I consent to my child’s participation in activities where adults may be present and accept this inherent aspect of a mixed-age environment.

 

Consent to Participate

I give permission for my child to participate in FlowMotion activities, including but not limited to dance rehearsals, performances, filming sessions, and promotional shoots that may take place offsite from FlowMotion’s primary studio location.

 

Consent to Filming & Media Use

I understand that my child may be photographed, filmed, or recorded during FlowMotion activities.

I grant FlowMotion permission to use such photos, videos, and recordings for promotional, educational, and marketing purposes (including websites and social media), without compensation, now or in the future.

 

Consent to Transportation

I understand that my child may be transported to and from offsite locations related to FlowMotion activities if necessary.

Transportation may be provided by FlowMotion instructors, staff, organizers, or designated adults. I acknowledge that transportation is provided as a convenience and that FlowMotion is not acting as a common carrier.

Medical Authorization

In the event of an emergency where I cannot be reached, I authorize FlowMotion representatives to seek necessary medical treatment for my child. I understand that I am financially responsible for any medical expenses incurred.

 

Assumption of Risk

I understand that participation in dance activities, rehearsals, filming, performances, offsite events, and transportation involves inherent risks, including but not limited to physical injury, accidents, or unforeseen incidents.

I voluntarily assume all risks associated with my child’s participation.

 

Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and hold harmless FlowMotion, its owners, instructors, staff, contractors, volunteers, and affiliates from any and all claims, liabilities, demands, damages, or causes of action arising out of or related to:

• Participation in FlowMotion activities

• Offsite rehearsals, filming, or events

• Transportation to or from FlowMotion-related activities

• The independent actions or behavior of other participants
   

This release applies to claims resulting from ordinary negligence, but does not apply to gross negligence or willful misconduct where prohibited by law.
